Terms of Service

The agreement between you and PetAura when you use the app or site.

1. Acceptance of Terms

By downloading, installing, or using the PetAura mobile application (the "App") or the website at petaura.pet (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Site.

These Terms constitute a legally binding agreement between you and PetAura ("we," "our," or "us"). By creating an account, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.

2. Eligibility

You must be at least 13 years of age to use PetAura. By creating an account, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of Service

PetAura is a pet health and care tracking platform that allows pet owners to:

  • Create and manage pet profiles (breed, age, health history, care routines)
  • Log daily health and activity data (food, activity, mood, weight, bathroom habits, sleep, symptoms)
  • Set and receive care reminders (vaccines, medications, grooming, vet visits)
  • View health trends and charts over time
  • Store and access veterinary records and documents
  • Use an AI Assistant to ask questions about their pet's health and receive personalized insights
  • Search a local database of pet service providers (vets, groomers, pet stores) by postal code

PetAura is a health tracking and information tool. It is not a veterinary service. See §6 for the important veterinary disclaimer.

4. Account Registration

To use PetAura, you must create an account using a valid email address and password. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials and not share your password with any third party
  • Notify us immediately at petaura.mobileapp@gmail.com if you suspect unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain false, inaccurate, or misleading information.

5. Subscription, Trial, and Billing

5.1 Subscription Tiers

PetAura offers two service tiers:

Free Tier - available to all users at no charge, subject to usage limits:

  • AI chat queries: 5 per day
  • AI health insights: 1 per day
  • Local service searches: 1 per day

Premium Tier - a paid subscription with expanded limits:

  • AI chat queries: 25 per day
  • AI health insights: 4 per day
  • Local service searches: 4 per day (up to 24 per month)
  • Up to 3 pets on a single account

5.2 Free Trial

New users are eligible for a 14-day free trial of the Premium tier. The trial begins when you activate it within the App.

Important: Your free trial will automatically convert to a paid Premium subscription at the end of the 14-day period unless you cancel before the trial expires. You will not be charged if you cancel before the trial period ends.

5.3 Pricing

Prices are subject to change. We will notify existing subscribers of any price changes before they take effect.

5.4 Billing and Payment

All billing for Premium subscriptions is processed by:

  • Apple (for App Store purchases on iOS devices) in accordance with Apple's payment terms
  • Google (for Google Play purchases on Android devices) in accordance with Google's payment terms

PetAura does not collect or store your payment card details. Your payment information is handled directly by Apple or Google.

5.5 Auto-Renewal

Premium subscriptions automatically renew at the end of each billing period (monthly or annual, as selected) at the then-current subscription price, unless cancelled before the renewal date.

5.6 Cancellation

You may cancel your subscription at any time through:

  • iOS: Settings → Apple ID → Subscriptions → PetAura → Cancel Subscription
  • Android: Google Play Store → Subscriptions → PetAura → Cancel Subscription

Cancellation takes effect at the end of your current paid period. You retain access to Premium features until the period ends. Cancelling your subscription does not delete your account or data.

5.7 Refunds

Refund requests are handled by Apple or Google in accordance with their respective refund policies. PetAura does not directly issue refunds for App Store or Google Play purchases.

6. Veterinary Disclaimer

IMPORTANT: PetAura is not a veterinary service and is not a substitute for professional veterinary care.

The information, content, logs, trends, and AI-generated responses provided through PetAura are for informational and tracking purposes only. Nothing in the App constitutes veterinary diagnosis, medical advice, or a recommendation to take or refrain from taking any specific action regarding your pet's health.

Always consult a licensed veterinarian for questions about your pet's health, symptoms, medications, or medical conditions. In the event of a veterinary emergency, contact your veterinarian, an emergency animal hospital, or an animal poison control service immediately.

PetAura expressly disclaims any liability arising from reliance on information or AI-generated content provided through the App for veterinary or medical decision-making.

7. AI Assistant - Limitations and Disclaimer

The PetAura AI Assistant uses third-party artificial intelligence technology (Abacus AI, model gpt-4o-mini) to generate responses to your questions. By using the AI Assistant, you acknowledge:

  • AI-generated responses are informational only and subject to the veterinary disclaimer in §6
  • AI responses may be inaccurate, incomplete, or outdated - always verify important health information with a licensed veterinarian
  • Your queries and the AI's responses are transmitted to and processed by Abacus AI (a third-party service) and are stored in PetAura's database - see our Privacy Policy for details
  • Daily usage limits apply (see §5.1): free users receive 5 AI queries and 1 AI insight per day; Premium users receive 25 queries and 4 insights per day
  • Usage limits reset at midnight

PetAura is not responsible for decisions made based on AI-generated content.

8. User Content and Data

8.1 Your Content

You retain ownership of all pet data, logs, records, and files you enter or upload into PetAura ("Your Content"). By submitting Your Content, you grant PetAura a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely for the purpose of providing the Service to you.

8.2 Accuracy of Your Content

You are responsible for the accuracy of the information you enter. PetAura is not responsible for errors in health records, reminders, or logs that result from inaccurate data entry.

8.3 Uploaded Documents

You may upload veterinary documents and other files through the Health Records section. You represent that you have the right to upload any files you submit and that those files do not violate any applicable law or third-party rights.

9. Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to PetAura's systems, databases, or other users' accounts
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use the App to transmit malware, spam, or any harmful or disruptive content
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the App in any way that could disable, overburden, or impair the proper functioning of the Service
  • Attempt to circumvent usage limits or access Premium features without a valid subscription

10. Intellectual Property

The App, Site, PetAura name and logo, mascot characters, design elements, and all content produced by PetAura (excluding Your Content) are owned by or licensed to PetAura and are protected by applicable copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from PetAura's proprietary content without our express written permission.

11. Disclaimers and Limitation of Liability

11.1 Disclaimer of Warranties

THE APP AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PETAURA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES RESULTING FROM RELIANCE ON AI-GENERATED CONTENT OR PET HEALTH INFORMATION.

IN NO EVENT SHALL PETAURA'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO PETAURA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Termination

12.1 By You

You may delete your account at any time through the App settings or by submitting a request at /delete-account. Deleting your account cancels any active subscription (subject to the billing cycle terms in §5.6) and results in permanent deletion of your personal data as described in our Privacy Policy.

12.2 By PetAura

We reserve the right to suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to the security or integrity of the Service or other users. If we terminate your account without cause, we will provide a pro-rated refund of any prepaid subscription fees where required by applicable law.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the App shall be resolved by binding arbitration in Ontario, Canada, except that either party may seek injunctive relief in a court of competent jurisdiction for matters involving intellectual property or unauthorized access.

Nothing in this section limits your rights under applicable consumer protection laws in your jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via the App or by email at least 14 days before the changes take effect. Your continued use of the App after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App and delete your account before the effective date.

15. Miscellaneous

  • Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and PetAura with respect to the App and supersede all prior agreements.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
